Who we are

pozare is operated by Spyros Gavriil and Panagiotis Tsembekis, individuals based in the Republic of Cyprus. pozare is not currently operated by a registered company. Contact: hello@pozare.com.

The service and its beta status

pozare lets an organiser create an event and share a link or QR code so guests can upload photos to a shared gallery without an account. The organiser can moderate, download and delete photos. pozare is in an early pilot: it is provided "as is", features may change, and we do not guarantee uninterrupted availability or that photos will never be lost. Download and keep your own copy of anything you cannot afford to lose.

Who can use it

Organisers and waitlist members must be 18 or older. Guests who upload photos must be old enough to agree to these terms where they live, or have a parent or guardian's permission. Joining the waitlist does not guarantee access, a launch date or any particular feature.

Organisers

An organiser is responsible for their event, including who receives the link. Anyone who has the event link may be able to view or upload photos, depending on the gallery and moderation settings the organiser chooses. Organisers must keep their sign-in links and sessions secure.

By creating an event the organiser confirms that they:

• have the right to collect photos at the event and to use any logo or image they upload;
• will tell guests that photos will be collected and shown, for example with the notice we provide, and will obtain any consent the law requires, including a parent's or guardian's consent for children;
• will respond to guests who ask for their photos to be removed; and
• are the controller of the guest photos, with pozare acting as their processor as described in our privacy notice. The organiser instructs us to store, process, display and delete photos as the app allows, and we will handle photos only on those instructions.

Guests and uploads

You may only upload photos you took or have permission to share. You keep ownership of your photos. You give the organiser and pozare a non-exclusive, worldwide, royalty-free licence to store, process (including resizing and generating previews), display, and allow download of your photos for the purpose of running that event's gallery. The licence ends when the photo or event is deleted, apart from short-lived backups.

What you must not do

You must not upload or share content that is illegal, sexually explicit, exploits or endangers children, is hateful, harassing or threatening, shows people in a way that violates their privacy or dignity, infringes someone else's rights, or contains malware. You must not gain unauthorized access to the service, disrupt it, evade its limits, or use bots or scrapers against it or the waitlist form, or submit someone else's email without their permission.

Reporting and removing content

To report illegal or abusive content, or to ask for a photo that shows you to be removed, email hello@pozare.com with the event link, a description of the photo and why it should be removed. We review reports promptly and may remove content or suspend an event without notice where we reasonably believe these terms or the law have been breached. When we remove content because of a report or a breach, we will tell the affected organiser or uploader the reason where we can. You can appeal by replying to that message.

Event lifetime and deletion

Photos and event data are deleted automatically 90 days after an event is closed (or, if it is never closed, 90 days after the event date), as described in our privacy notice. Organisers should download the photos they want before then. An organiser can delete an event earlier, and we may delete or suspend an event that breaches these terms.

Free pilot events and payments

The pozare pilot events are currently free. pozare does not take payment and there is no paid subscription. Before we start charging, we will publish pricing and purchase terms, including cancellation and refund information and any consumer withdrawal rights, and existing organisers will not be charged without agreeing to them.

Our content and brand

The pozare name, logo, illustrations, software and website content belong to us or our licensors. No permission is granted to copy or reuse them except as allowed by law. The operators are reviewing and documenting ownership or licence records for all visual assets before launch.

Links to other services

The website links to Instagram, TikTok and email services. Those services are operated independently and their own terms and privacy notices apply when you use them.

Our responsibility

Nothing in these terms limits rights you have by law that cannot be limited, or our liability for death or personal injury caused by negligence, fraud or anything else that cannot be excluded. Subject to that, and because the pilot is free, we are not liable for loss of photos or data, loss of business or indirect losses, and our total liability for anything arising from the service is limited to the amount you paid us for it, which for the free pilot is nil. Organisers are responsible for the content of their events and agree to cover reasonable losses we suffer from a third-party claim caused by their breach of these terms.

Changes, suspension and ending

We may change, update, suspend or take down the website or any part of the service at any time. We will give organisers reasonable notice of material changes to these terms where we can, for example by email. You can stop using pozare at any time, and organisers can delete their event. We may suspend or end access for breaches of these terms or to comply with the law.

Governing law and disputes

These terms are governed by the laws of the Republic of Cyprus, and the courts of Cyprus have jurisdiction, without removing any mandatory consumer rights you have in the country where you live. If you are a consumer in the EU you can also use the European Commission's online dispute resolution platform. Contact us first and we will try to resolve any issue informally.
